Horton Press retains all applicable ownership rights in its proprietary data assets, including:

  • Databases and database structures.
  • Data compilations and organizational systems.
  • Platform-generated metadata.
  • Application configurations.
  • System records and operational information.
  • Proprietary analytics and statistical information.
  • Software-generated reports.
  • Aggregated or de-identified datasets lawfully created by Horton Press.

These assets remain the property of Horton Press to the extent recognized by applicable law.

4.2 User-Submitted Information

Users may submit journal entries, goals, photographs, documents, rosters, educational materials, and other information.

Users retain any intellectual property rights they legally possess in their original submissions.

By submitting content, users grant Horton Press a worldwide, nonexclusive, royalty-free license to store, process, reproduce, transmit, display, format, back up, and otherwise use that content as reasonably necessary to operate, maintain, secure, and improve the Products and Services.

This license is subject to applicable privacy laws and deletion requirements.

4.3 Personal Information

Horton Press maintains operational control over its systems and the information processed within them, subject to applicable law and individual privacy rights.

Nothing in these Terms eliminates legally protected rights concerning personal information.

4.4 Aggregated and De-Identified Information

Horton Press may create, retain, and use aggregated or de-identified information for analytics, security, product development, performance evaluation, and legitimate business purposes, where permitted by law.

5. PRIVACY AND DATA PROTECTION

Personal information is processed according to applicable Horton Press Privacy Policies and legal requirements.

Different Products and Services may collect different categories of information.

Horton Press may engage third-party providers for hosting, payments, authentication, communications, analytics, and other operational functions.

Access to information is governed by applicable permissions, privacy settings, organizational roles, and legal requirements.

Users and organizations are responsible for obtaining necessary authorization before submitting another person's information.

6. ORGANIZATIONS, COACHES, AND ADMINISTRATORS

Certain Services allow users to manage teams, organizations, classrooms, or groups.

Organizational administrators are responsible for:

  2. Obtaining legally required permissions.
  3. Assigning appropriate access privileges.
  4. Protecting confidential information.
  5. Restricting access to legitimate organizational purposes.
  6. Complying with applicable privacy and child protection requirements.
  7. Managing authorized representatives.

Horton Press may investigate reported misuse and restrict organizational access when necessary.

Horton Press does not control independent coaching, instructional, or organizational decisions made by customers.

7. THE WRESTLING JOURNAL APP

The Wrestling Journal provides tools for athletic reflection, training documentation, goal setting, and coaching.

7.1 Journal Privacy

Journal entries are private by default.

Joining a team does not automatically authorize coaches to view private journal content.

Authorized coaches may access limited participation information, including membership, completion status, and activity streaks.

Coaches may view journal content only when the athlete enables the applicable sharing permissions.

Athletes may disable sharing through available application controls.

Disabling sharing prevents future access through the applicable sharing feature but does not guarantee deletion of copies previously obtained by authorized recipients.

7.2 Coaching Features

Coaches may suggest goals, provide feedback, and interact with shared information according to applicable permissions.

7.3 Athletic Disclaimer

The Wrestling Journal is a training and reflection tool.

It does not provide medical diagnoses, treatment recommendations, individualized nutritional advice, or professional healthcare services.

8. YOURTEAMMANAGER

YourTeamManager provides athletic team and organizational management software.

Organizations are responsible for maintaining accurate information and obtaining appropriate authorization to manage participant records.

Administrative access is limited to authorized organizational purposes.

Horton Press may restrict or revoke access when necessary to address misuse, security concerns, contractual violations, or legal requirements.

9. TEACHER TIMER AND EDUCATIONAL APPLICATIONS

Teacher Timer and related educational applications support classroom timing, instructional organization, and related activities.

Educators remain responsible for classroom supervision, instructional decisions, and compliance with institutional policies.

Unless expressly stated otherwise, these applications are not intended to serve as official student information systems or permanent educational record repositories.

Users should not submit sensitive student information unless the applicable Service expressly supports its collection.

10. WEB HOSTING AND COMMERCIAL SERVICES

Horton Press may provide website hosting, development, maintenance, domain-related services, and other commercial digital solutions.

These Services may be governed by additional agreements, including:

  • Customer Services Agreements.
  • Master Service Level Agreements.
  • Statements of Work.
  • Quotes and invoices.
  • Other accepted commercial agreements.

Where an applicable written agreement conflicts with these Terms regarding the same subject, the specific agreement controls.

10.1 Customer Responsibilities

Hosting customers are responsible for:

  • The legality of hosted content.
  • Obtaining necessary intellectual property permissions.
  • Maintaining appropriate account security.
  • Complying with applicable laws.
  • Maintaining independent copies of important information unless backup obligations are expressly assigned to Horton Press.

10.2 Backups

Unless expressly guaranteed in writing, Horton Press does not guarantee the availability, completeness, or recoverability of customer backups.

All purchases are subject to these Terms and applicable supplemental agreements.

Customers agree to pay all disclosed charges, including applicable taxes, shipping fees, subscription fees, and other costs.

Horton Press may modify pricing for future purchases or renewal periods, subject to applicable law and contractual obligations.

12.2 All Sales Final and No Refund Policy

ALL SALES ARE FINAL. HORTON PRESS DOES NOT OFFER REFUNDS, RETURNS, EXCHANGES, OR CREDITS EXCEPT WHERE REQUIRED BY APPLICABLE LAW, EXPRESSLY PROVIDED IN A SEPARATE WRITTEN AGREEMENT, OR AUTHORIZED BY HORTON PRESS AT ITS SOLE DISCRETION.

This policy applies to:

  • Physical books, journals, and printed publications.
  • Digital publications, eJournals, and downloadable materials.
  • Custom artwork and personalized products.
  • Mobile, desktop, and web applications.
  • Individual and organizational software licenses.
  • Recurring subscriptions.
  • Website hosting and maintenance.
  • Development, consulting, and professional services.
  • Future Horton Press products and services.

Customer dissatisfaction, nonuse, accidental purchases, or changes in personal circumstances do not independently establish refund eligibility.

Nothing in this policy eliminates rights that cannot legally be waived.

12.3 Physical Products

Physical publication sales are final.

Horton Press does not accept returns or exchanges based solely on customer preference or changes of mind.

Customers receiving damaged, defective, incorrect, or materially nonconforming products should contact Horton Press.

Horton Press will provide remedies required by applicable law.

12.4 Digital Products

Digital product purchases are final except where applicable law requires otherwise.

Customers are responsible for reviewing disclosed compatibility requirements.

12.5 Custom Products

Custom journals, personalized publications, artwork, and made-to-order products are nonrefundable except where required by law or expressly agreed otherwise.

Custom orders may not be canceled or modified after design or production begins without Horton Press's written authorization.

12.6 Subscriptions

Subscriptions may renew automatically according to the terms disclosed during purchase.

Subscription payments are nonrefundable except where required by law.

Cancellation ordinarily prevents future renewals but does not entitle customers to refunds or prorated credits for the current billing period.

12.7 Free Trials

Trial duration, conversion terms, payment requirements, and cancellation procedures will be disclosed when offered.

Customers must cancel before the applicable conversion deadline to avoid charges when a trial automatically converts to a paid subscription.

12.8 Third-Party Purchases

Purchases through Apple or other marketplaces are subject to applicable marketplace billing and refund procedures.

Horton Press does not control third-party refund decisions.

12.9 Hosting and Professional Services

Payments for hosting, development, maintenance, consulting, and related Services are nonrefundable except where required by law or a binding written agreement.

12.10 Billing Disputes

Customers should report suspected billing errors to support@hortonpress.com.

Nothing in these Terms restricts lawful chargeback rights or other mandatory consumer protections.

12.11 Exceptions

Horton Press may authorize discretionary refunds, replacements, exchanges, or credits.

An exception in one instance does not establish an obligation to provide future exceptions.

13. INTELLECTUAL PROPERTY

Horton Press retains all applicable intellectual property rights in its software, source code, designs, branding, trademarks, publications, documentation, proprietary databases, and platform technology.

Users receive a limited, nonexclusive, nontransferable, revocable license to access and use Products and Services for authorized purposes.

Purchasing a product or Service does not transfer ownership of Horton Press intellectual property unless expressly agreed in writing.

14. CUSTOM ARTWORK AND CUSTOMER BRANDING

14.1 Customer Branding

Schools, businesses, athletic teams, organizations, and individuals retain all existing rights to their respective names, logos, trademarks, mascots, slogans, and other preexisting branding materials ("Customer Branding").

Submitting Customer Branding does not transfer ownership to Horton Press.

Customers represent that they own or possess the necessary authorization to use submitted materials.

Customers grant Horton Press a nonexclusive, royalty-free license to incorporate Customer Branding into commissioned products and related authorized activities.

14.2 Ownership of Custom Artwork

ALL ORIGINAL CUSTOM ARTWORK, DESIGNS, ILLUSTRATIONS, LAYOUTS, COMPOSITIONS, TEMPLATES, AND OTHER CREATIVE MATERIALS DEVELOPED BY HORTON PRESS REMAIN THE EXCLUSIVE INTELLECTUAL PROPERTY OF HORTON PRESS LLC.

This includes custom journal covers, eJournal layouts, team-branded publications, organizational artwork, promotional graphics, and other original designs.

Incorporating Customer Branding into a custom design does not transfer ownership of Horton Press's original creative contributions.

Customers retain their preexisting rights to their branding.

Payment for custom artwork does not constitute a transfer or assignment of intellectual property rights.

Unless expressly agreed otherwise in writing, custom artwork is not considered a work made for hire.

14.3 Limited Use License

Purchasing a custom product grants a limited, nonexclusive, nontransferable license to use the finished product for its intended purpose.

Custom artwork may not be reproduced, modified, repurposed, redistributed, or used on products or materials not produced or expressly authorized by Horton Press without prior written permission.

Prohibited uses include:

  1. Reusing artwork on merchandise, apparel, websites, or promotional materials.
  2. Providing artwork to another printer, publisher, designer, or manufacturer.
  3. Extracting artwork from a publication or digital product.
  4. Tracing or recreating substantially similar copies of protected original artwork.
  5. Selling, sublicensing, or distributing artwork.
  6. Using artwork in additional commercial projects without authorization.

These restrictions do not prevent customers from independently using their own preexisting branding or exercising rights provided by law.

14.4 Vector and Source Files

HORTON PRESS DOES NOT PROVIDE VECTOR FILES, EDITABLE ARTWORK, OR ORIGINAL DESIGN SOURCE FILES AS PART OF CUSTOM PRODUCT PURCHASES.

This includes:

  • SVG, AI, and EPS files.
  • Adobe Illustrator, Photoshop, and InDesign source files.
  • Layered or editable design documents.
  • Original templates and production files.
  • Other working design assets.

Any delivered files are licensed only for their authorized purpose.

Horton Press may separately authorize additional licensing arrangements but is not obligated to provide source files.

14.5 Customer Approval

Customers are responsible for reviewing and approving proofs, artwork, and specifications when approval is requested.

Approval authorizes Horton Press to proceed with production.

Additional revisions or applications of existing artwork may require separate fees.

14.6 Unauthorized Use

Unauthorized reproduction, distribution, modification, or commercial use of protected Horton Press artwork may violate these Terms and applicable intellectual property laws.

Horton Press reserves the right to pursue available contractual and legal remedies.

15. MARKETING AND PROMOTIONAL USE OF CUSTOM ARTWORK

  4. Digital and printed portfolios.
  5. Brochures and promotional presentations.
  6. Product photography and mockups.
  7. Demonstrations of Horton Press design and publishing capabilities.

15.2 Customer Branding in Promotional Materials

By commissioning or purchasing custom artwork, customers grant Horton Press a nonexclusive, worldwide, royalty-free license to display and reproduce Customer Branding solely as incorporated into commissioned artwork or finished products for the promotional purposes described above.

This license does not transfer ownership of Customer Branding.

Horton Press may identify the school, business, team, or organization associated with completed projects when reasonably appropriate.

15.3 Approval and Compensation

Unless otherwise agreed in writing, Horton Press may exercise these promotional rights without additional compensation or advance approval.

15.4 Privacy and Confidentiality

Horton Press will not knowingly disclose confidential customer information, unpublished sensitive materials, or protected personal information through promotional use.

Artwork containing identifiable minors or other protected information remains subject to applicable privacy and consent requirements.

Customers requiring confidentiality or promotional restrictions must obtain Horton Press's written agreement before commissioning the work.

15.5 Survival

These promotional rights survive completion, cancellation, or termination of the customer relationship, subject to applicable law and written restrictions.

16. PUBLICATIONS AND EDUCATIONAL MATERIALS

16.1 Ownership

Horton Press retains applicable intellectual property rights in its original books, journals, workbooks, manuals, educational materials, and related publications.

Purchasing a physical publication transfers ownership of the purchased physical copy, not the underlying copyright.

16.2 Reproduction Restrictions

Purchasers may not reproduce, scan, digitize, republish, redistribute, or commercially exploit protected publication content without authorization, except as permitted by law.

16.3 Educational and Athletic Disclaimer

Publications may include coaching concepts, training exercises, athletic guidance, or educational information.

These materials are provided for general informational and educational purposes.

Horton Press does not guarantee particular athletic, academic, professional, or competitive outcomes.

16.4 Updates and Revisions

Horton Press may revise, replace, or discontinue publications.

Purchasing one edition does not entitle customers to future editions or updates unless expressly included.

17. DIGITAL PUBLICATIONS AND EJOURNALS

17.1 Digital Licensing

Digital publications, electronic journals, downloadable materials, and related products are licensed rather than sold to the extent permitted by law.

Purchasers receive a limited, nonexclusive, nontransferable license for authorized use.

17.2 Restrictions

Users may not:

  1. Redistribute or resell digital publications.
  2. Share purchased files beyond the applicable license.
  3. Remove copyright notices.

18. ORDERS, SHIPPING, AND FULFILLMENT

18.1 Pricing

Prices, shipping charges, taxes, and other applicable fees will be disclosed during checkout.

18.2 Order Acceptance

Submitting an order does not guarantee acceptance.

Horton Press may reject or cancel orders for legitimate reasons, including product unavailability, pricing errors, suspected fraud, or fulfillment limitations.

Payments collected for canceled and unfulfilled orders will be refunded as required by law.

18.3 Shipping

Shipping estimates are not guaranteed delivery dates unless expressly stated otherwise.

Horton Press is not responsible for delays outside its reasonable control except where applicable law requires otherwise.

18.4 Damaged or Incorrect Products

Customers should promptly report damaged, defective, missing, or incorrectly fulfilled products.

Horton Press may request reasonable documentation to investigate fulfillment issues.

  • Suspected fraud.
  • Security concerns.
  • Misuse of Services.
  • Nonpayment.

Termination does not eliminate accrued payment obligations or other surviving contractual duties.

23. THIRD-PARTY SERVICES

Horton Press may use third-party providers for hosting, payments, authentication, communications, infrastructure, and other functions.

Third-party products and services may be governed by separate terms.

Horton Press is not responsible for independent third-party conduct except where responsibility arises under applicable law or a binding agreement.

24. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

Nothing in these Terms excludes protections that cannot legally be waived.

25. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Horton Press LLC and its officers, employees, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or relating to its Products and Services.
